TERMS OF SERVICE

This acceptable use policy sets out the terms between you (the visitor to this website) and Kevin Hayward Art/The Hayward Studio under which you may access this website www.kevinhaywardart.com (“this site”). 

 

This acceptable use policy applies to all users of, and visitors to, this site. Your use of this site means that you accept, and agree to abide by, all the policies in this acceptable use policy, which supplement my terms of website use.

By using this site, you signify your acceptance of this policy and terms of service. If you do not agree to this policy, please do not use this site. Your continued use of this site following the posting of changes to this policy will be deemed your acceptance of those changes.  

STUDIO MEMBERSHIP TERMS AND CONDITIONS

  1. This agreement commences once you have completed the membership sign up process on this website and received your confirmation email.

  2. You will be entitled to all the member benefits set out on the Membership Plans webpage (www.kevinhaywardart.com/pricing-plans/list) for the type of membership plan purchased.

  3. The number of taught classes and open studio sessions offered in any given month is subject to change at the discretion of Kevin Hayward. However, to ensure value for money for members, there will be a minimum of one taught class and four open studio sessions available to book every month. 

  4. Your credit/debit card will be charged immediately and your membership will be effective from the date of purchase. Your card will then be charged the monthly membership fee each subsequent month on the same date until cancelled. Each payment made is not refundable under any circumstances. 

  5.  If a monthly fee card payment is not honoured, we will notify you of the missed payment. If, despite us having notified you of a missed payment, the fee is not paid and/or further payments are missed, we reserve the right to either suspend or terminate your membership, upon having given you written notice of our intention to do so. 

  6. From time to time we may need to increase the price of membership. We will give you at least 1 full months' notice of any incoming price increase and will make it very clear when the price increase will take effect and how much your membership will cost after the increase. During this period, you will have your usual right to terminate your membership in accordance with the membership terms and conditions and rules. If you do not terminate the membership by the date given to you in the notice, then the price of your membership will be increased in accordance with our notice.

  7. If you wish to upgrade or downgrade your membership, you will be required to cancel your current membership plan and purchase a different plan.

  8. You may terminate your membership at any point by logging in to your account on the website. In these circumstances your membership will remain in force until the day before your next payment is due, at which point it will automatically terminate.

  9. In accordance with GDPR regulations, we only hold personal information that is necessary for the purpose of your ongoing membership plan. We do not share or allow access to your information by any third party. Any data we have on record is kept on private and secure servers.

  10. You agree to advise us immediately of any change to the member details or payment details provided.

  11. You are not permitted to share your membership log in details with anyone else.

  12. You cannot transfer your membership to anyone else.

PRIVACY POLICY

This Privacy Policy governs the manner in which Kevin Hayward Art/The Hayward Studio collects, uses, maintains and discloses information collected from users of this website. Users may be asked for appropriate personal identification information to maintain contact when discussing requirements or our services, and for the solicitation of any feedback or service advocacy. Furthermore, we securely disregard any personal identification information we may hold, upon request.

We may collect non-personal identification information about users whenever they interact with this site. Non-personal identification information may include the browser name, the type of computer (device) and technical information about users' means of connection to this site, such as the operating system and the Internet service providers utilised and other similar information.

We do not sell, trade, or rent users personal identification information to others. We may share generic aggregated demographic information not linked to any personal identification information regarding visitors and users with trusted affiliates for the purposes outlined above. 

Kevin Hayward Art/The Hayward Studio has the discretion to update this privacy policy at any time. When we do, we will revise the updated date at the bottom of this page. We encourage users to frequently check this page for any changes to stay informed about how we are helping to protect the personal information we collect. You acknowledge and agree that it is your responsibility to review this privacy policy periodically and become aware of modifications.  

COOKIE POLICY

We use cookies to potentially personalise content, to provide social media features and to analyse traffic to this site. Cookies are small text files that can be used by websites to make a user’s experience more efficient. The law states that we can store cookies on your device if they are strictly necessary for the operation of this site. For all other types of cookies, we require your permission. You are not permitted to send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards below. You cannot transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam). You are not allowed to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware. 

You may not reuse any of the content published on our site to produce as your own work, whether for financial gain or not. The content on our site has been created by Kevin Hayward and is therefore protected under copyright law. This includes all artwork, copy, imagery that we have created, altered or manipulated from the original source which we accessed the rights to, or vector graphics created for this site.

SHOP POLICY

The fine art print products sold on this site are all original artwork by Kevin Hayward Art.

You are not permitted to resell or share these products with any other third parties without explicit permission to do so, which is not generally implied. 

 

By purchasing a product from our shop, you are agreeing to comply with these terms and conditions. Failure to adhere to the above could result in potential legal action.
